Code of Conduct

PURPOSE AND SCOPE

This Code of Conduct exists to foster mutual respect, appreciation, and safety for all members of the dance community. It outlines expected behavior, prohibited behavior, reporting options, and possible consequences to ensure a welcoming environment for everyone. It applies to any events, dances, lessons, or activities run by this organization, as well as online spaces managed by the organization.

 

RESPECT, INCLUSION, AND COMMUNITY STANDARDS

  • Our events and activities are for everyone, regardless of age, race, ethnicity, nationality, religion, disability, physical appearance, level of dance experience, sexual orientation, gender, or gender identity.
  • Treat all attendees, instructors, DJs, volunteers, and board members with kindness and respect.
  • Be polite and comply with reasonable requests from staff, volunteers, and board members.
  • Dancers of all ages and skill levels will be present. Help us create a welcoming environment, especially for new dancers.
 
 

ONLINE COMMUNITY STANDARDS

  • All ESDC-managed online platforms (including social media groups, email lists, and messaging services) are subject to the same standards of respect and safety outlined in this Code of Conduct.
  • Harassment, hate speech, demeaning language, personal attacks, doxxing, or any behavior that makes others feel unsafe will not be tolerated.
  • Posts or messages that violate these standards may result in removal from the online community and/or disciplinary action under the Terms of Service.
 
 

CONSENT, BOUNDARIES, AND PERSONAL AUTONOMY

  • Everyone has the right to say “no” or “stop” at any time, without explanation.
  • Respect physical and personal boundaries on and off the dance floor.
  • You may:
    • Decline any invitation to dance
    • Stop a dance early
    • Choose your dance role (lead, follow, or switch, with partner consent)
    • Change partners, dance again, or take a break
  • If someone says “no” or “stop,” honor their request immediately. Consent can be withdrawn at any time.
  • Never pressure anyone to dance, continue dancing, perform movements, or engage in conversation against their wishes.
  • If you are unsure of anyone’s boundaries or cannot read their nonverbal cues, ask.
  • If you misjudge and are asked to stop (verbally or nonverbally), stop immediately.
  • Alcohol or other substances can impair judgment; be mindful of your limits so you can be mindful of others.
 
 

HARASSMENT AND MISCONDUCT

  • Harassment or threats of any kind will not be tolerated.
  • Any behavior that makes another person feel unsafe or unable to enjoy the event may be considered harassment.
  • Harassment or misconduct can include (but is not limited to):
    • Unwanted physical contact
    • Sexual remarks, propositions, jokes, or gestures
    • Displays of sexual or offensive imagery
    • Hostile, intimidating, or abusive language or behavior
    • Stalking
    • Disruption of lessons or social dancing
    • Unwelcome photography or videography
    • Offensive or hostile online or in-person communications
    • Malicious rumor-spreading or presenting false statements as fact
  • Illegal behavior is prohibited, including drug use, theft, property damage, or providing alcohol to minors.
  • Smoking (including e-cigarettes) is prohibited indoors.
  • Anyone who appears intoxicated or poses a danger to others may be removed.
 
 

BYSTANDER RESPONSIBILITY

  • Help us create a community of care and a safe environment.
  • If you are unsure whether someone is okay, check in if you feel safe doing so:
    • Ask them to dance to help remove them from a situation
    • Ask in a friendly way if they need help
  • Report concerns using the processes specified below.
 
 

REPORTING A CONDUCT CONCERN

  • If you experience or witness harassment, unsafe behavior, or other conduct concerns, contact event staff immediately.
  • Reports will be handled with respect, confidentiality, and seriousness.
  • Reports can be made:
    • To any person on the board of directors
      • If you do not know who the board members are, please ask your teacher, the table staff, or the DJ to connect you with one.
    • Via email to the club email address
  • A written report should include:
    •  Your name and contact information
    • The date and description of the incident
    • Names and contact information of people who witnessed the incident
    • The names and/or description of any offending parties

If you are not comfortable sharing your information, anonymous reports will be reviewed and taken seriously; however, our ability to investigate or take action may be limited without identifying information.

  • Retaliation against anyone who reports a conduct concern, raises a safety issue, or participates in an investigation is prohibited and may result in disciplinary action.
  • Event staff are not trained mental health or crisis workers. In emergencies, contact emergency services.

 

CONSEQUENCES OF UNACCEPTABLE BEHAVIOR

Anyone asked to stop unacceptable behavior is expected to do so immediately.

Depending on severity, or upon repeated violations, responses may include:

  • A conversation requesting a change in behavior
  • Immediate removal from the event/activity without warning or refund
  • A probationary period
  • Denial of admission or removal from future events/activities either for a specific duration (suspension) or permanently (banning)
  • Revocation of club membership (if applicable)
 
 

RIGHT TO REFUSE

  • We are committed to maintaining a safe and welcoming environment. Violations of this Code of Conduct may result in removal from events, suspension, or denial of future participation, as outlined in our Terms of Service. Enforcement decisions will not be based on protected class status. ESDC reserves the right to refuse service to anyone.

This Code of Conduct is part of ESDC’s Terms of Service. Participation in ESDC events and activities is subject to both this Code of Conduct and the Terms of Service.

Terms of Service

DEFINITIONS
“ESDC” refers to the Eugene Swing Dance Club, its affiliated entities, staff, volunteers, contractors, instructors, and board members. “The Service” means all ESDC activities, programs, events, classes, workshops, social dances, competitions, meetings, online communities, and other services offered or operated by ESDC, including any digital or online platforms, websites, and social media channels. “Participant” means any individual who attends or participates in ESDC events or activities, including but not limited to attendees, members, guests, volunteers, instructors, vendors, judges, and contractors. “User” means any individual who uses or interacts with ESDC online platforms, including websites, registration portals, email lists, or social media channels.


SCOPE & AGREEMENT TO TERMS
These Terms of Service apply to all Participants and Users of ESDC. By purchasing a ticket or membership, registering for an event or class, entering an ESDC event space, or using any ESDC online platform, you agree to comply with these Terms of Service and all ESDC policies, including but not limited to the Code of Conduct. Violations of any policy may be treated as violations of these Terms of Service and may result in disciplinary action, including denial of admission, removal from events, suspension, or banning.


ELECTRONIC AGREEMENT
By completing any online transaction or form with ESDC (including ticket or membership purchases via digital payment service, membership signups, or event registrations), or by joining or engaging with ESDC’s mailing list, you agree to these Terms of Service. Your electronic acceptance (such as clicking “submit,” “pay,” or checking a box) constitutes a legally binding agreement to these Terms. You acknowledge that these Terms are available electronically and that you may print or download them for your records.


PARTICIPATION AND ASSUMPTION OF RISK
Participation in ESDC events and activities involves physical activity and inherent risks, including but not limited to physical exertion, contact with other participants, and the risk of injury. Participation is voluntary. By participating, you acknowledge and accept these risks and agree that you are responsible for assessing your own physical condition, limitations, and fitness to participate, and for participating in a manner appropriate to your abilities.  


MEDIA RELEASE
ESDC may photograph or record video at events and activities for promotional, educational, or archival purposes. By participating in the Service, you consent to ESDC capturing and using your image, likeness, or voice in photos or recordings taken by or on behalf of ESDC. ESDC may use these materials on its website, social media, newsletters, and other promotional or informational materials without compensation or further approval from you.


ENFORCEMENT & RIGHT TO REFUSE
ESDC reserves the right, in its sole discretion, to interpret and enforce these Terms of Service and all related policies, including the Code of Conduct. ESDC may refuse service, deny admission, remove any participant, or suspend or ban individuals from events or activities for violations of these Terms or related policies, or for behavior that ESDC determines to be unsafe, disruptive, or inconsistent with its mission. ESDC also reserves the right to take immediate action, including removal from an event or activity without warning, if it determines that a participant’s behavior poses a risk to the safety, well-being, or enjoyment of others, or to the safe operation of the event.


MINORS
Participation by minors is subject to ESDC policies and may require parental or guardian consent, supervision, or additional documentation. Parents or legal guardians are responsible for the conduct, supervision, and safety of any minor in their care and agree to these Terms of Service on the minor’s behalf.


NO WARRANTY
ESDC provides the Service and all related activities and content on an “as is” and “as available” basis. To the fullest extent permitted by law, ESDC makes no warranties, express or implied, regarding the Service, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. ESDC does not guarantee that the Service will be uninterrupted, error-free, or free from defects or viruses.  


LIABILITY
ESDC, including its directors, board members, employees, volunteers, contractors, affiliates, and service providers, shall not be liable to you or any third party for any actions, suspension, or discontinuation of the Service. To the fullest extent permitted by law, ESDC shall not be liable for any injury, loss, claim, or damages of any kind, whether direct, indirect, incidental, punitive, special, or consequential, arising from or related to your participation in ESDC activities, use of ESDC services, or any content made available through the Service. This includes, without limitation, any errors or omissions in content, or any loss or damage resulting from the use of the Service. Because some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, ESDC’s liability in such jurisdictions shall be limited to the greatest extent permitted by applicable law. 


INDEMNIFICATION
You agree to indemnify, defend, and hold harmless ESDC, its directors, board members, employees, volunteers, affiliates, contractors, and service providers from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of or related to your participation in ESDC events or activities, your breach of these Terms of Service, or your negligent or wrongful acts.


REFUND POLICY
Refunds may be provided only in accordance with ESDC refund policies. Any person found in contempt of our Terms of Service and Policies, and anyone banned or suspended from ESDC events for any reason, shall forfeit their membership fees, admission and not be entitled to a refund.


CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of our services or access to our website to these Terms of Service constitutes acceptance of those changes.


SEVERABILITY
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.


GOVERNING LAW / JURISDICTION
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.
